CONCERNING NUISANCES
ENFORCEABLE BY THE SURETÉ DU QUÉBEC
WHEREAS under section 59 of the Municipal Powers Act (Q.R.S., chapter C-47, 1), any local municipality may adopt by-laws relating to nuisances;
WHEREAS the municipality has received a request from the RCM of Pontiac asking it to update its by-laws in general,
WHEREAS Councillor Julien Gagnon, gave notice of motion at a regular meeting of council heldJuly 11, 2023
CONSEQUENTLY it is moved by Katie Sharpe, that this by-law repeals and replaces all previous By-Laws relating to nuisances, as enforceable by the Sureté du Québec.
IT IS ALSO RESOLVED that this by-law be adopted:
“Preamble” SECTION 1 The preamble forms an integral part of this by-law.
“Definition” SECTION 2 For the purposes of this by-law, the term “waste” means: any abandoned, unusable, obsolete or deteriorated movable property or scrap of any kind and, without restricting the generality of the foregoing, any carcass of vehicles, residue of a production, transformation or use process substance, material or product.
“Noise/general”
SECTION 3 It is a prohibited nuisance to provoke or incite in any way whatsoever, noise that is likely to disturb the peace and well-being of the neighbourhood, or likely to be heard at the limits of the property.
“Works” SECTION 4 It is a prohibited nuisance to cause noise that is likely to disturb the peace and well-being of the neighbourhood by performing construction work, demolition or repairs to a building or vehicle, between 10:00 p.m. and 7:00 a.m., except in the case of emergency work intended for the safety of people or the premises.
“Show/music” SECTION 5 It is a nuisance and prohibited to emit or permit the production of shows or the broadcasting of music, the sounds of which may be heard beyond the area from which the noise originates, except when and where authorized by the municipality by resolution or special permit.
“Fireworks” SECTION 6 It is a prohibited nuisance to use firecrackers or fireworks or to allow their use.
The municipality or one of its representatives may issue a permit authorizing the use of fireworks.
“Firearms” SECTION 7 It is a prohibited nuisance to walk with, make use of or discharge a firearm, a compressed air or gas weapon, a spring weapon, a bow or a crossbow, a slingshot, a pea-shooter or any other device, instrument or system designed to launch projectiles;
- at a distance of less than thirty (30) meters from any house, building or structure, without a reasonable excuse;
- from a public road as well as on a width of ten (10) meters on each exterior side of a right-of-way, without a reasonable excuse;
- from a fenced pasture in which are found farm animals;
- from a private property, without having first obtained permission from the owner, the owner’s representative or the premises’ occupant.
“Light” SECTION 8 It is a prohibited nuisance to project light outside the place of origin if it is likely to cause a danger for the public or an inconvenience to citizens.
“Fire” SECTION 9 It is a prohibited nuisance to ignite a fire or maintain a fire ignited on a private property without a permit, except in the case of wood fires ignited in specially designed fireplaces.
A compliant fireplace is one constructed of a non-combustible materials and fitted with a screen or spark arrestor cover with openings no larger than 1 cm in diameter.
The municipality or one of its representatives may issue a permit authorizing a fire for a specific event, subject to the following conditions:
- The applicant undertakes to ensure constant supervision of premises by a responsible major person.
- A safety area as decided by the municipality must be established by the applicant, so that neighbouring areas and the general public are protected.
- The applicant undertakes to respect all applicable safety standards.
- The applicant shall ensure that an extinguishing product or agent is present, and in sufficient quantity.
- The applicant shall demonstrate that he or she possesses the appropriate public liability insurance.
- No open fire ban by the proper authorities shall be in force.
“Presence prohibited”
SECTION 10
It is considered a prohibited nuisance for anyone to enter or to stay on a property, land or lot, building, yard, school or church yard, garden, shed, garage, depot or private lane, without the express consent of the owner, the owner’s representative or the premises’ occupant, and without a reasonable motive.
It is also considered a prohibited nuisance for anyone to remain on a private property after being asked to leave by the owner, the owner’s representative or the premises’ occupant, without a reasonable motive.
“Waste/objects”
SECTION 11 It is a nuisance and prohibited to leave, deposit or throw waste or any other residual material on public or private property.
“Right of inspection”
SECTION 12 Council authorizes officials of the municipality (inspectors) to visit and examine any movable or immovable property, between 7:00 a.m. and 7:00 p.m., as well as the exterior or interior of any house, building or structure, to discover whether by-laws are executed therein, and thus all owners, tenants or occupants of such houses, buildings and structures must receive these persons.
“Application” SECTION 13 The person responsible for the application of this by-law shall be any official or municipal employee appointed by Council.
Council also authorizes all peace agents of the Sureté du Québec to undertake criminal proceedings against any contravener, and to issue statements of violation for any offence to one of the provisions of this by-law.
“Other remedies by the
Municipality
SECTION 14 Notwithstanding any criminal prosecution, the Municipality may pursue any other remedy necessary to enforce the provisions of this by-law.
“Penalty”
SECTION 15 Whoever contravenes a provision of this by-law, with the exception of section 7, commits an offence and is liable to a fine of two hundred and fifty dollars ($250.00) in the case of a natural person, and five hundred dollar ($500.00) in the case of a legal entity, for a first infraction: the fine is five hundred dollars ($500.00) in the case of natural person, and one thousand dollars ($1000,00) in a case of a legal entity, for any repeat offence during the following year: in each case, legal expenses shall be additional.
Whoever contravenes section 7 of this by-law commits an offence and is liable to a fine of five hundred dollars ($500.00), plus expenses.
“Abrogation” SECTION 16 This by-law abrogates all previous municipal by-laws, including By-Law 2011-03 which are incompatible with its provisions.
“Coming into force”
SECTION 17 This by-law shall come into force according to law.
By-Law 2023-03 was adopted by the Municipal Council during a meeting held August 8, 2023 and signed by the Mayor and the Director General

EXÉCUTOIRE PAR LA SURETÉ DU QUÉBEC
ATTENDU QU’en vertu de l’article 59 de la Loi sur les compétences municipales (Q.RS , chapitre C-47, 1), toute municipalité locale peut adopter des règlements relatifs aux nuisances ;
CONSIDÉRANT QUE la municipalité a reçu une demande de la MRC de Pontiac lui demandant de mettre à jour ses règlements en général,
ATTENDU QUE le conseiller Julien Gagnon, a donné avis de motion lors d’une séance ordinaire du conseil tenue11 juillet 2023
EN CONSÉQUENCE il est proposé par Katie Sharpe, que ce règlement abroge et remplace tous les règlements antérieurs relatifs aux nuisances, tels qu’applicables par la Sureté du Québec.
IL EST AUSSI RÉSOLU que ce règlement soit adopté :
« Préambule » SECTION 1 Le préambule fait partie intégrante du présent règlement.
« Définition » SECTION 2 Aux fins du présent règlement, le terme « déchet » désigne : tout bien meuble ou rebut de toute nature abandonné, inutilisable, désuet ou détérioré et, sans restreindre la généralité de ce qui précède, toute carcasse de véhicule. , résidu d’un procédé de production, de transformation ou d’utilisation d’une substance, d’un matériau ou d’un produit.
“Bruit/général”
SECTION 3Est une nuisance interdite le fait de provoquer ou d’inciter, de quelque manière que ce soit, du bruit susceptible de troubler la paix et le bien-être du voisinage, ou susceptible d’être entendu aux limites de la propriété.
“Travaux” SECTION 4 Est une nuisance interdite le fait de provoquer du bruit susceptible de troubler la paix et le bien-être du voisinage en effectuant des travaux de construction, de démolition ou de réparation d’un immeuble ou d’un véhicule, entre 22h00 et 19h00. le matin, sauf en cas de travaux d’urgence destinés à la sécurité des personnes ou des locaux.
“Spectacle/musique” SECTION 5Il est nuisible et interdit d’émettre ou de permettre la production de spectacles ou la diffusion de musique dont les sons peuvent être entendus au-delà de la zone d’où provient le bruit, sauf quand et où autorisé par la municipalité par résolution ou permis spécial.
“Feux d’artifice” SECTION 6 Il est interdit d’utiliser des pétards ou des feux d’artifice ou d’en permettre l’utilisation.
La municipalité ou l’un de ses représentants peut délivrer un permis autorisant l’utilisation de feux d’artifice.
“Armes à feu” SECTION 7Est une nuisance interdite le fait de marcher, d’utiliser ou de décharger une arme à feu, une arme à air comprimé ou à gaz, une arme à ressort, un arc ou une arbalète, une fronde, un tire-pois ou tout autre appareil, instrument ou système conçu pour lancer des projectiles;
- à une distance de moins de trente (30) mètres de toute maison, bâtiment ou structure, sans excuse raisonnable ;
- à partir d’un chemin public ainsi que sur une largeur de dix (10) mètres de chaque côté extérieur d’une emprise, sans excuse raisonnable ;
- d’un pâturage clôturé dans lequel se trouvent des animaux de ferme ;
- provenant d’une propriété privée, sans avoir obtenu au préalable l’autorisation du propriétaire, de son représentant ou de l’occupant des lieux.
« Lumière » ARTICLE 8 Est une nuisance interdite le fait de projeter de la lumière à l’extérieur du lieu d’origine si elle est susceptible de causer un danger pour le public ou un inconvénient pour les citoyens.
« Feu » SECTION 9 Il est interdit d’allumer ou d’entretenir un feu allumé sur une propriété privée sans permis, sauf dans le cas de feux de bois allumés dans des foyers spécialement conçus.
Un foyer conforme est un foyer construit à partir de matériaux incombustibles et équipé d’un écran ou d’un pare-étincelles dont les ouvertures ne dépassent pas 1 cm de diamètre.
La municipalité ou l’un de ses représentants peut délivrer un permis autorisant un incendie pour un événement déterminé, aux conditions suivantes :
- Le demandeur s’engage à assurer une surveillance constante des lieux par une personne majeure responsable.
- Une zone de sécurité décidée par la municipalité doit être établie par le demandeur, afin que les zones avoisinantes et le grand public soient protégés.
- Le demandeur s’engage à respecter toutes les normes de sécurité applicables.
- Le demandeur doit s’assurer qu’un produit ou agent extincteur est présent et en quantité suffisante.
- Le demandeur doit démontrer qu’il possède une assurance responsabilité civile appropriée.
- Aucune interdiction de feu à ciel ouvert émanant des autorités compétentes ne sera en vigueur.
« Présence interdite »
ARTICLE 10
Il est considéré comme une nuisance interdite à quiconque d’entrer ou de séjourner sur une propriété, un terrain ou un terrain, un bâtiment, une cour, une cour d’école ou d’église, un jardin, une remise, un garage, un dépôt ou une allée privée, sans le consentement exprès du propriétaire, du représentant du propriétaire ou de l’occupant des lieux, et ce, sans motif raisonnable.
Est également considéré comme une nuisance interdite le fait pour quiconque de demeurer sur une propriété privée après avoir été prié de quitter le propriétaire, son représentant ou l’occupant des lieux, sans motif raisonnable.
“Déchets/objets”
ARTICLE 11 Il est nuisible et interdit de laisser, déposer ou jeter des déchets ou toute autre matière résiduelle sur la propriété publique ou privée.
“Droit de contrôle”
ARTICLE 12Le Conseil autorise les fonctionnaires de la municipalité (inspecteurs) à visiter et examiner tout bien meuble ou immeuble, entre 7h00 et 19h00, ainsi que l’extérieur ou l’intérieur de toute maison, bâtiment ou construction, pour découvrir si par -Les lois y sont exécutées, et ainsi tous les propriétaires, locataires ou occupants de telles maisons, bâtiments et structures doivent recevoir ces personnes.
« Application » ARTICLE 13 La personne responsable de l’application du présent règlement est tout fonctionnaire ou employé municipal nommé par le Conseil.
Le conseil autorise également tous les agents de la paix de la Sureté du Québec à entreprendre des poursuites criminelles contre tout contrevenant et à émettre des constats de violation pour toute infraction à l’une des dispositions du présent règlement.
“D’autres remèdes par le
Municipalité
ARTICLE 14Nonobstant toute poursuite criminelle, la Municipalité peut exercer tout autre recours nécessaire pour faire respecter les dispositions du présent règlement.
“Peine”
ARTICLE 15Quiconque contrevient à une disposition du présent règlement, à l’exception de l’article 7, commet une infraction et est passible d’une amende de deux cent cinquante dollars (250,00 $) s’il s’agit d’une personne physique, et de cinq cents dollars (500,00 $) ) dans le cas d’une personne morale, pour une première infraction : l’amende est de cinq cents dollars (500,00 $) dans le cas d’une personne physique, et de mille dollars (1 000,00 $) dans le cas d’une personne morale, pour toute récidive infraction au cours de l’année suivante : dans chaque cas, les frais de justice seront supplémentaires.
Quiconque contrevient à l’article 7 du présent règlement commet une infraction et est passible d’une amende de cinq cents dollars (500,00 $), plus frais.
« Abrogation » ARTICLE 16 Le présent règlement abroge tous les règlements municipaux antérieurs, incluant le règlement 2011-03 qui sont incompatibles avec ses dispositions.
“Entrée en vigueur”
ARTICLE 17Le présent règlement entre en vigueur conformément à la loi.
Le règlement 2023-03 a été adopté par le conseil municipal lors d’une séance tenue le 8 août 2023 et signé par le maire et le directeur général.
