REGULATION NUMÉRO 460
CONCERNING DOOR-TO-DOOR SALESPEOPLE
WHEREAS Council deems it advisable to adopt a by-law concerning door-to-door salespersons;
WHEREAS a notice of motion was duly given by Katie Sharpe on April 25, 2023 at the meeting of this Council;
THEREFORE it is moved by Katie Sharpe and resolved that draft by-law 460 be adopted and that it be ordered and decreed as follows:
- Door-to-door salesperson means any person who carries goods or merchandise of any kind on the streets or public squares of the Municipality, either to offer them for sale or to sell them;
- Any door-to-door salesperson must behave in such a way as not to impede traffic on the streets of the Municipality, and must not leave his or her vehicle parked on said streets longer than is necessary to make his or her offer or sale;
- All door-to-door salespersons, in order to carry on their business, must obtain an annual permit from the Municipality, which will only be issued upon payment of the following amounts:
- All door-to-door solicitation and sales within the Municipality of Shawville require a permit.
The price is as follows
-All sales by non-residents – $100.00
-All sales by residents – $25.00
Charitable and non-profit organizations – free of charge
Permit valid for (1) one week
For a person to be considered a resident of the Province or within the boundaries of the Municipality, that person must have actually resided in the said Province or Municipality continuously for a period of twelve (12) months prior to applying for a permit. .
Any person ceasing to reside in the Province or within the limits of the Municipality must obtain the required permit.
- Any police officer shall have the right to require any door-to-door salesman to produce his permit, and if he fails to do so, he may arrest him without warrant and bring him before the courts;
- Council may, at its discretion, suspend or revoke any permit if there is evidence of harassment, fraud or any other valid reason decided by the Municipality.
- Any person contravening the provisions of the present by-law will be liable to a fine of $150.00.
- Said penalty is without prejudice to the rights of the Municipality to claim the amount required for the permit, as specified above;
This by-law will come into force in accordance with the law.
By-law number 460 was adopted as read at a regular council meeting held May 9, 2023 and will come into force in accordance with the law.

RÈGLEMENT NUMÉRO 460
RELATIF AU VENDEUR DE PORTE À PORTE
ALORS QUE Le conseil juge opportun d’adopter un règlement concernant les vendeurs à domicile;
ATTENDU QU’un avis de motion a été dûment donné par Katie Sharpe le 25 avril 2023 lors de la séance de ce Conseil ;
DONC il est proposé par Katie Sharpe et résolu que le projet de règlement 460 soit adopté et qu’il soit ordonné et statué comme suit :
- Vendeur à domicile désigne toute personne qui transporte avec elle, dans les rues ou places publiques de la Municipalité, des biens, ou des marchandises quelles qu’elles soient, soit pour les offrir en vente, soit pour les vendre ;
- Tout vendeur en porte à porte doit se comporter de manière à ne pas gêner la circulation dans les rues de la municipalité et ne doit pas laisser son véhicule stationné dans lesdites rues plus longtemps qu’il n’est nécessaire pour faire son offre ou sa vente ;
- Tout vendeur à domicile, afin d’exercer son commerce, doit obtenir chaque année un permis de la Municipalité, qui ne sera délivré que sur paiement des montants suivants :
- Toute sollicitation et vente porte à porte au sein de la municipalité de Shawville nécessite un permis.
Le prix est le suivant
-Toute vente par des non-résidents – 100,00$
-Toutes ventes par les résidents – 25,00$
-Organisations caritatives et à but non lucratif – gratuit
Le permis est valable (1) une semaine
Pour qu’une personne soit considérée comme un résident de la Province ou à l’intérieur des limites de la Municipalité, cette personne doit avoir effectivement résidé dans ladite Province ou Municipalité de façon continue pendant une période de douze (12) mois avant de demander un permis. .
Toute personne cessant de résider dans la Province ou dans les limites de la Municipalité devra obtenir le permis requis.
- Tout agent de police aura le droit d’exiger de tout vendeur en porte-à-porte qu’il présente son permis et s’il ne le fait pas, il pourra l’arrêter sans mandat et le traduire devant les tribunaux ;
- Le Conseil peut, à sa discrétion, suspendre ou révoquer tout permis s’il existe des preuves de harcèlement, de fraude ou toute autre raison valable décidée par la Municipalité.
- Toute personne contrevenant aux dispositions du présent règlement sera passible d’une amende de 150,00 $.
- Ladite pénalité est sans préjudice des droits de la Municipalité de réclamer le montant requis pour le permis, tel que précisé à ce qui précède ;
Le présent règlement entrera en vigueur conformément à la loi.
Le règlement numéro 460 a été adopté tel que lu lors d’une séance ordinaire du conseil tenue le 9 mai 2023 et entrera en vigueur conformément à la loi.
