WHEREAS the Council of the Village of Shawville deems it

advisable to adopt a bylaw to set conditions concerning fires on the municipality.

WHEREAS a notice of motion was given by Councillor Bill McCleary at a council meeting held on May 23, 2017.

BURNING PERMIT – OPEN FIRES

WHEREAS no burning permit will be issued from May 1st to September 30th, unless prior approval has been obtained from the Fire Department;

WHEREAS a burning permit is valid for 7 consecutive days;

WHEREAS a burning permit may be refused if weather conditions or the location of the fire are unsuitable for burning;

WHEREAS a burning permit does not allow the burning of anything other than unprocessed wood. Not permitted is furniture, appliances, carpets, shingles, tires, mattresses, etc ..;

WHEREAS all burning permits are numbered sequentially;

WHEREAS it is forbidden to light an open fire in the Municipality of Shawville without a burning permit obtained from the Municipality and that the permit holder must agree to notify the Shawville/Clarendon Fire Department before lighting the fire;

CONSIDERING THAT “Nuisance” (SQ 2011-02) means

Excessive smoke or odor from fires is not permitted;

WHEREAS uncontrollable fires will be the responsibility of the permit holder and total extinguishing costs will be charged;

WHEREAS the owner or occupant of any land on which a fire occurs or originates shall be considered the person responsible for starting such fire and shall incur the penalties provided for such offence, unless such person is able to prove to the satisfaction of the court that such fire was not started by himself or by anyone employed or under his control;

CONSIDERING THAT “Out-of-control fires” (SQ 2011-02)

Out-of-control fires are subject to a fine of $100.00 and the total cost of extinguishing the fire, i.e. a truck cost of $150.00 per hour and labor costs per hour for a maximum of 20 to 30 firefighters at 2 hours. minimum call. Minimum fire calls generally exceed $1,000.00 (one thousand dollars);

WHEREAS no permit will be used when :

a) The risk of fire is high due to weather conditions ;

b) There is a danger to neighbouring properties;

c) The Municipality and/or the fire department deem that the fire hazard is too high for any other reason;

WHEREAS permits may be revoked at any time.

CONFINED FIREPLACES WITH AN ENGRAVED PROTECTIVE DEVICE

CONSIDERING THAT the screened appliance must be made of non-combustible

materials ;

WHEREAS fires must be contained within the appliance;

WHEREAS the volume of burned material must not exceed

24 x 24 x 24 inches (60 x 60 x 60 cm) ;

CONSIDERING THAT the appliance must be supervised at all times;

WHEREAS the appliance must be located on a non-combustible surface extending beyond the appliance to a dimension equal to the height of the appliance;

WHEREAS the appliance must be at least 3 metres (9 feet, 9 inches) from any combustible material – i.e. buildings, fences, trees, property lines and roads;

CONSIDERING THAT if the top of the appliance is screened, the screen must be small enough to act as a spark arrester;

CONSIDERING THAT you are authorized to burn unprocessed wood only;

THEREFORE, Article 3 ENTRY INTO FORCE

This by-law shall come into force in accordance with the law.

By-law number 432-2017-002 was read and adopted on a motion by Bill Hobbs and seconded by Bill McCleary at a regular council meeting held on June 13, 2017 and will come into force in accordance with the law.
