MUNICIPALITY OF SHAWVILLE
REGULATION NUMÉRO 460
CONCERNING DOOR-TO-DOOR SALESPEOPLE
WHEREAS Council deems it advisable to adopt a by-law concerning door-to-door salespersons;
WHEREAS a notice of motion was duly given by Katie Sharpe on April 25, 2023 at the meeting of this Council;
THEREFORE it is moved by Katie Sharpe and resolved that draft by-law 460 be adopted and that it be ordered and decreed as follows:
- Door-to-door salesperson means any person who carries goods or merchandise of any kind on the streets or public squares of the Municipality, either to offer them for sale or to sell them;
- Any door-to-door salesperson must behave in such a way as not to impede traffic on the streets of the Municipality, and must not leave his or her vehicle parked on said streets longer than is necessary to make his or her offer or sale;
- All door-to-door salespersons, in order to carry on their business, must obtain an annual permit from the Municipality, which will only be issued upon payment of the following amounts:
- All door-to-door solicitation and sales within the Municipality of Shawville require a permit.
The price is as follows
-All sales by non-residents – $100.00
-All sales by residents – $25.00
Charitable and non-profit organizations – free of charge
Permit valid for (1) one week
For a person to be considered a resident of the Province or within the boundaries of the Municipality, that person must have actually resided in the said Province or Municipality continuously for a period of twelve (12) months prior to applying for a permit. .
Any person ceasing to reside in the Province or within the limits of the Municipality must obtain the required permit.
- Any police officer shall have the right to require any door-to-door salesman to produce his permit, and if he fails to do so, he may arrest him without warrant and bring him before the courts;
- Council may, at its discretion, suspend or revoke any permit if there is evidence of harassment, fraud or any other valid reason decided by the Municipality.
- Any person contravening the provisions of the present by-law will be liable to a fine of $150.00.
- Said penalty is without prejudice to the rights of the Municipality to claim the amount required for the permit, as specified above;
This by-law will come into force in accordance with the law.
By-law number 460 was adopted as read at a regular council meeting held May 9, 2023 and will come into force in accordance with the law.
