MUNICIPALITY OF SHAWVILLE

 BY-LAW NUMBER 451

REGULATION CONCERNING THE OBLIGATION

TO INSTALL A SAFETY VALVE (NON-RETURN VALVE)

 IN ANY BUILDING SERVED BY THE MUNICPAL SEWER SYSTEM

WHEREAS section 19 of the Municipal Powers Act which allows any local municipality to adopt by-laws concerning environmental matters;

WHEREAS it is in the Municipality’s and in the citizens’ best interests to regulate the installation of security valves (non-return valves);

WHEREAS the present By-Law is meant to avoid sewage back-ups;

WHEREAS a notice of motion was duly given by Jaime Christie at the regular meeting held on
June 23, 2020, in order to adopt the present By-Law;

CONSEQUENTLY, it is proposed by councilor Jaime Christie, supported by councilor Denzil Yach and unanimously resolved:

THAT the present By-Law is adopted accordingly to the following:

ARTICLE 1

The preamble is an integral part of the present By-Law.

ARTICLE 2

Requirements for connection to sewers (sanitary and storm):

2.1   All owner of a building served by the municipal sewer system must install, at its own costs, and maintain in good working order a security valve (non-return valve) in order to avoid any sewer back-ups.

2.2   Installation and maintenance standards of security valves (non-return valves) are those prescribed in the National Plumbing Code of Canada 1995 (CNRC 38728F) including August 1999 and March 2002 modifications published by the Canadian Commission on Building and Fire Codes of the National Research Council Canada.

2.3   All amendments to the National Plumbing Code after the coming into force of the present By-Law become an integral part of the present By-Law at a determined date following the adoption of a resolution to that effect by the municipal council, in accordance with section 6 (6°) of the Municipal Powers Act.

2.4   When a building is already erected, the owner has a one (1) year delay starting at the moment of the coming into force of the present By-Law, to comply with the present By-Law.

2.5    In case of failure by an owner to comply with the present By-Law and install and maintain in good working order a security valve (non-return valve), in conformity with the present By-Law, the Municipality will not be held responsible for all and any damages caused to the owner’s building and/or its contents, following the consequences of a sewer back-up.

ARTICLE 3

The designated official (building inspector) is authorized to visit and/or inspect, if necessary, any building in order to ensure the compliance of the present By-Law.

ARTICLE 4

The present By-Law will come into force after the completion of the formalities enacted by law.
